Welcome to Verified Remediation. These Terms of Service ("Terms") govern your access to and use of the Verified Remediation website, platform, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, submitting a lead request, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Services

Verified Remediation operates an online marketplace that connects homeowners seeking mold assessment or remediation services ("Homeowners") with licensed mold professionals ("Contractors"). Our Services include:

  • A directory of mold professionals with verified licensing and insurance information
  • Lead generation and routing to connect Homeowners with appropriate Contractors
  • Tools for Contractors to manage their profiles, leads, and communications
  • Verification services for professional licenses and insurance coverage

Important: Verified Remediation is a lead generation platform. We do not perform mold assessments or remediation services ourselves. We are not a party to any agreement between Homeowners and Contractors.

3. User Accounts

Account Creation

Certain features of our Services require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorized access to your account

Account Responsibility

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Homeowner Terms

If you use our Services as a Homeowner, you agree to:

  • Provide accurate information about your project and contact details
  • Respond to Contractors in a timely manner when expressing interest
  • Not submit fraudulent or misleading lead requests
  • Independently verify any Contractor's credentials before hiring
  • Understand that we do not guarantee the quality of any Contractor's work

No Endorsement: Listing a Contractor on our platform is not an endorsement or recommendation. While we verify license and insurance status, we do not vouch for the quality of work, pricing, or reliability of any Contractor.

5. Contractor Terms

If you use our Services as a Contractor, you agree to:

Licensing and Insurance

  • Maintain all licenses required by applicable state and local laws
  • Maintain adequate liability insurance coverage
  • Promptly notify us of any changes to your license or insurance status
  • Provide accurate and up-to-date credential information

Lead Handling

  • Respond to leads professionally and in a timely manner
  • Provide accurate quotes and information to Homeowners
  • Not contact Homeowners for services other than those requested
  • Not share lead information with third parties

Credit System

  • Purchase credits to receive lead contact information
  • Credits are non-refundable except as specified in our refund policy
  • Credits may expire according to the terms disclosed at purchase

Profile Accuracy

  • Ensure your profile information is accurate and not misleading
  • Not make false claims about your certifications, experience, or capabilities
  • Update your service areas and availability as needed

6. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any laws
  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Scrape, harvest, or collect data from the Services without authorization
  • Use automated systems to access the Services in a manner that exceeds reasonable use
  • Send spam or unsolicited communications
  • Post or transmit any harmful, defamatory, or offensive content
  • Circumvent any technical measures we use to provide the Services

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by Verified Remediation and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Services without our prior written consent.

8. Third-Party Services

Our Services may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or availability of such third-party services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

  • Any warranties that the Services will meet your requirements
  • Any warranties that the Services will be uninterrupted, timely, secure, or error-free
  • Any warranties regarding the accuracy of license or insurance verification
  • Any warranties regarding the quality, reliability, or performance of any Contractor
  • Any warranties regarding the outcome of any work performed by Contractors

Verification of licenses and insurance is based on information provided by third-party sources and may not be current or complete. You should independently verify any Contractor's credentials before hiring.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERIFIED REMEDIATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

This includes, without limitation, damages arising from:

  • Any work performed or not performed by Contractors
  • Any disputes between Homeowners and Contractors
  • Any inaccuracies in license or insurance verification
  • Your use of or inability to use the Services
  • Unauthorized access to or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Verified Remediation, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Services
  • (For Contractors) Any work you perform or fail to perform

12. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to contact us to attempt to resolve the issue informally.

Arbitration

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in [State].

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Governing Law

16. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Verified Remediation regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
